Welcome to www.broadleafgroup.com.au (Website). This Website is operated by Broadleaf Financial Group Limited (ABN 83 618 739 790) (we, us or our). 

The Website provides information about Broadleaf, our partnership model, and the financial planning businesses we work with. It is provided for general information purposes only and does not constitute financial, legal, credit, or investment advice, nor an offer or invitation to invest. 

Please read these terms and conditions (Terms) carefully. By accessing or using this Website, you agree to be bound by these Terms. If you do not agree with these Terms, you must stop using this Website immediately. 

  1. Definitions

In these Terms: 

Australian Consumer Law means Schedule 2 of the Competition and Consumer Act 2010 (Cth). 

Content means all text, graphics, logos, images, data, and other material on this Website. 

Intellectual Property Rights means all copyright, trade marks, patents, designs, and other intellectual property rights, whether registered or unregistered. 

Personal Information has the meaning given in the Privacy Act 1988 (Cth). 

You or your means any person who accesses or uses this Website. 

  1. About Broadleaf

Broadleaf takes minority equity stakes in financial planning businesses and then provides support in various ways.  

Broadleaf does not hold an Australian Financial Services Licence (AFSL) and does not provide financial product advice. Broadleaf does not hold an Australian Credit Licence (ACL). Broadleaf’s involvement in financing arrangements is limited to business and commercial purposes conducted with business counterparties and does not extend to consumer credit as defined under the National Consumer Credit Protection Act 2009 (Cth). 

Broadleaf does not manage funds on behalf of third parties and does not operate, nor does this Website describe, a managed investment scheme. Each investment made by Broadleaf is a direct, individually negotiated commercial transaction and is not part of any pooled or collective investment arrangement. 

  1. Geographic Scope: Australian Residents Only

This Website and its Content are intended for Australian residents only and are provided in accordance with Australian law. We make no representation that the Content is appropriate, available, or lawful in any other country. 

If you access this Website from outside Australia, you do so on your own initiative and are responsible for compliance with the laws of your jurisdiction, to the extent those laws apply. Nothing on this Website is intended as an offer, invitation, or solicitation to any person outside Australia. 

Unless otherwise stated, all references to currency or monetary amounts on this Website are in Australian dollars (AUD).

  1. No Data Collection Through This Website

This Website does not include a contact form, enquiry form, or email sign-up facility, and does not directly collect Personal Information from visitors through such means. Any Personal Information that may be collected through this Website (for example, through standard web server logs) is handled in accordance with our Privacy Policy. 

If you wish to contact us, please use the contact details set out in clause 22.

You and we submit to the non-exclusive jurisdiction of the courts of Western Australia and any courts that may hear appeals from those courts in respect of any proceedings arising out of or in connection with these Terms.

Severability: If any provision of these Terms is found to be void, invalid, or unenforceable, that provision will be severed to the extent necessary, and the remaining provisions will continue in full force and effect. 

Waiver: Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by us to be effective. 

Assignment: You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms without restriction. 

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of this Website and supersede all prior or contemporaneous communications and proposals.
